THE MOST CONTESTED COST IN MOTOR CLAIMS

Credit hire is where small claims become large ones.

A short repair can carry a hire bill many times the cost of the repair itself. Defending those claims properly means knowing what was reasonably needed, for how long, at what rate, and whether the claimant genuinely had no alternative.

01

Review

The hire agreement, invoices and repair timeline are examined.

02

Test

Rate, need, period and impecuniosity are challenged against the evidence.

03

Resolve

Settlement is negotiated, or the matter is prepared for litigation.

FOUR QUESTIONS, ASKED PROPERLY

Every credit hire claim turns on the same points.

Need asks whether a replacement vehicle was required. Period asks how long it was reasonably required for. Rate asks what a comparable vehicle would have cost on the open market. Impecuniosity asks whether the claimant could have hired without credit. Answering all four with evidence is what decides these claims.

01

Receipt

The hire claim is presented and logged.

02

Disclosure

Agreements, invoices and repair records are obtained.

03

Analysis

Each limb of the claim is tested against the evidence.

04

Outcome

The claim is settled at a defensible figure or defended.

EVIDENCE WINS ARGUMENTS

What we build the challenge on.

01

Repair Timeline

Our own engineering and repair progression milestones measured against the hire period claimed, which a standalone defence provider cannot do.

02

Basic Hire Rate

GTA rates where the claim falls inside the agreement, evidenced spot rates where it does not.

03

Need

Vehicle use, alternatives available and actual mileage examined.

04

Impecuniosity

Financial position tested wherever the claimant asserts it.

Hire claims should cost what they are worth.

The repair file and the hire claim sit in the same platform, so the repair timeline used to challenge the hire period comes from our own records rather than the other side’s. Defending a hire claim from our own file is a materially stronger position than defending it from documents supplied by the claimant’s solicitor.

01

Reduced hire spend

Periods and rates brought back to defensible levels.

02

Stronger positions

Challenges supported by documented evidence.

03

Fewer escalations

Well evidenced positions tend to settle earlier.

04

Consistent handling

The same tests applied to every claim.
